The L-1 visa program allows foreign companies throughout the world to relocate their qualified employees to a branch, subsidiary, parent or affiliate company located in the United States. To qualify for an L-1 visa, the transferred foreign employee must have been employed abroad by the foreign branch, subsidiary, parent or affiliate office of the U.S. entity for at least one continuous year out of the three-year period immediately preceding the date of application for the L-1 visa.

The L-1 visa is a good way for small or start-up companies located outside of the United States to expand their business and services to the U.S. marketplace. This is advantageous to smaller companies because it allows for the transfer of highly proficient managers or executives who have direct knowledge of the foreign company’s operations, allowing the set-up of a new branch in the USA in compliance with the goals and objectives of the foreign company’s home office.

Generally, a citizen of a foreign country who wishes to enter the United States must first obtain a visa, either a non-immigrant visa for temporary stay, or an immigrant visa for permanent residence. You must have a student visa to study in the United States. Your course of study and the type of school you plan to attend determine whether you need an F-1 visa or an M-1 visa.

The United States welcomes foreign citizens who come to the United States to study. Before applying for a visa, all student visa applicants are required to be accepted and approved by their school or program. Once accepted, educational institutions will provide each applicant the necessary approval documentation to be submitted when applying for a student visa.

The E-2 treaty investor visa is a non-immigrant visa which allows foreign entrepreneurs from treaty nations to enter into USA and carry out investment and trade activities. Investment activities include the purchase or start-up of a new business. The investment must be significantly proportional to the total investment required, generally held to mean more than half of the total value of the enterprise or, if it is a new business, an amount normally considered necessary to establish the business.

There is no specified minimum amount required per U.S. immigration law as to the amount or proportion that qualifies as “substantial”. An investment of at least $100,000 is considered substantial in most cases. However, it is not a fixed amount, and an investment of much less can sometimes qualify, depending on the nature of the business.

The U.S. EB-3 visa allows immigrant workers to obtain permanent residence (a Green Card) in the United States. “EB” stands for “Employment Based”, which means that this type of permanent residence visa requires a company in America to employ the immigrant worker on a permanent, full-time basis once the immigrant has arrived in the United States.

The EB-3 visa is available to all foreign nationals, regardless of their country of citizenship or their current residence. Unlike other types of U.S. permanent resident visa categories, the EB-3 visa requires no investment of any kind, it does not require the immigrant’s country of origin to have any particular treaty status with the United States, there are no language requirements, no work or specialized skill requirements, and no educational requirements.

To qualify for the EB-3 visa, the immigrant must simply be available to accept a full-time position of employment from a qualified employer in the USA who is willing to sponsor the immigrant worker.

The Immigrant Investor Visa Program – established by the EB-5 visa option – is available to foreign nationals who invest at least $500,000 into a new commercial enterprise employing at least 10 full-time U.S. workers. And for individuals who invest in a qualified project under sponsorship of a Regional Center, the investor is able to meet the employment-related requirements of this visa category by reliance on an economic impact report – alleviating the need for the direct employment requirement specified under this visa option.

The EB-5 visa program is a low-risk immigration option for people who have the financial resources to qualify for this investment-based Green Card program. There are no language, education, skill or age requirements, and it does not require receipt of a job offer from a U.S. employer.
